ActiveProspect was thrilled to attend the Mass Torts Made Perfect (MTMP) Fall Seminar 2024 in Las Vegas last week. As one of the largest gatherings of mass tort and class action professionals, MTMP provided an exciting opportunity to connect with legal experts, share knowledge, and showcase our consent-based marketing solutions for compliance and lead generation.

The ActiveProspect team was able to connect with numerous attendees and actively discuss how to navigate the specific complexities of marketing and compliance in the legal space. Furthermore, our team was able to attend several insightful speaker sessions designed to help shape the future of legal lead generation. 

The session on “Compliance in Legal Advertising and Lead Generation” addressed the critical need for compliance in national mass tort advertising. Hosts Cason Carter (Broughton Partners) and Bob Goldwater (Goldwater Law Firm) discussed the ethical requirements under ABA Model Rule 5.3, which governs lawyers’ responsibilities when working with non-lawyers, including vendors and marketing agencies.

A key takeaway was the importance of thoroughly vetting lead generation vendors, not just focusing on cost-per-case metrics. They emphasized ensuring leads are sourced ethically and comply with TCPA and HIPAA regulations, sharing examples where poor vetting led to significant financial and legal consequences for law firms.

Additionally, in “The Future of Mass Tort Marketing” session, Steve Nober (Consumer Attorney Marketing Group) highlighted the challenge of case fallout, where up to 40% of signed cases don’t meet compensability criteria. Nober stressed the need for early medical record validation and suggested using local PR and connected marketing strategies to generate better leads. He also warned of upcoming FCC changes to TCPA regulations in January 2025, requiring explicit consent for all auto-dialing and text messaging, urging firms to update their TCPA disclaimers accordingly.
