FCC’s TCPA 1-to-1 Consent Rule no more?

It looks like the TCPA 1-to-1 consent countdown is over (for now)!
Today, January 24th, 2025, the FCC issued an order postponing the 1-to-1 Consent Rule for up to 12 months.
“For these reasons, we find that justice requires postponement of the effective date of the rule and we therefore postpone the effective date for the revised 47 CFR § 64.1200(f)(9) of the Commission’s rules by 12 months, to January 26, 2026, or until, following a decision from the Eleventh Circuit on the petition filed by the IMC, the Commission issues a Public Notice specifying a sooner date, in which case that sooner date would apply.”
Then moments later, the Eleventh Circuit Court of Appeals granted the Insurance Marketing Coalition’s petition!
This is a lot of information to unpack so we are still trying to understand the implications!
ActiveProspect supports this decision, however, we also still support the spirit of the 1-to-1 rule which is to give consumers more control over who contacts them. While not a legal requirement, we believe it is still a best practice. While the industry made significant changes this past year to comply with these new rules, we don’t think that effort was in vain. The FCC, FTC, state attorneys general, and other regulators continue signaling the need for greater transparency and consumer choice in handling personal data.
ActiveProspect remains committed to supporting industry initiatives and technology solutions that provide more consumer control and empower responsible data processing. Consent-based marketing ensures that businesses contact only those who provide prior express written consent to be contacted, fostering trust and compliance. By focusing on transparency, consumer choice, and combating unethical practices, we aim to lead the way in creating a trustworthy marketing ecosystem.
We look forward to collaborating with clients, partners, and regulators in refining and implementing rules that drive the future of consent-based marketing.
We plan to hold a webinar next week with experts to provide a more detailed analysis of this news! Stay tuned!
